The Swedish Parliament has this week adopted the government’s proposal for a new patent law that will enter into force on January 1, 2025. The new law adapts Swedish legislation to both the European Patent Convention and the Agreement on a Unified Patent Court. These changes cover, among other things, which inventions can be patented and the patent holder’s exclusive rights, where two new exceptions are introduced for plant breeding and the use of computer programs.
To streamline the processing and make the patent process more understandable, the rules on how to handle a patent application are also clarified. At the same time, the Patent Act is undergoing a linguistic and editorial modernization to become more transparent and easier to apply.
